These Terms of Service (“Terms”) govern your access to and use of Keraann.com and your purchase of products from our online store.

The Website and online store operate under the store name KERAANN (“we,” “us,” or “our”).

Our online store is hosted using Shopify’s ecommerce platform, which provides the Website and checkout infrastructure used to operate our online store.

By accessing the Website or submitting an order, you agree to these Terms. If you do not agree with these Terms, please do not use the Website or place an order.

1. Eligibility and Customer Information

You must be at least the age of majority in your state of residence to place an order.

You agree to provide accurate, current, and complete information during checkout, including your name, email address, telephone number, billing information, and shipping address.

You are responsible for reviewing your information before submitting an order and for maintaining the confidentiality of any customer-account credentials where applicable.

2. Products and Product Information

KERAANN offers glassware and related drinkware for everyday drinking, dining, beverage service, and home entertaining.

Our product selection may include drinking glasses, tumblers, cocktail glasses, stemmed glasses, beer glasses, wine glasses, and other glass drinkware.

We make reasonable efforts to display product descriptions, dimensions, capacities, materials, colors, configurations, photographs, quantities, and prices accurately.

However:

Colors and transparency may appear slightly different depending on lighting, photography, and individual screen settings;

Product dimensions and capacities may vary slightly because of manufacturing and measurement methods;

Glass thickness, shape, finish, and transparency may have minor variations;

Small bubbles, minor surface marks, or other visual differences may occur as normal characteristics of glass manufacturing;

Individual pieces within the same glassware set may have minor differences; and

Beverages, food, decorative items, or accessories shown in product photographs are not included unless specifically stated in the product description.

Customers should review the complete product description, size, capacity, quantity, material, and other specifications before ordering.

3. Product Use and Care

Our glassware is intended for the uses described on the applicable product page.

Glass products are breakable and should be handled carefully.

Customers should inspect glassware before use. Products that are cracked, chipped, broken, or otherwise visibly damaged should not be used.

Unless expressly stated otherwise on the applicable product page:

Glassware should not be placed directly on an open flame or stovetop;

Glassware should not be used in an oven or microwave unless specifically identified as suitable for that purpose;

Sudden or extreme temperature changes should be avoided because they may cause thermal shock;

Glassware should not be assumed to be freezer-safe, oven-safe, microwave-safe, or suitable for boiling liquids unless specifically stated;

Appropriate cleaning and care instructions should be followed; and

Stemware and other delicate glass products should be handled with additional care.

Damage caused by dropping, impact, misuse, thermal shock, improper cleaning, alteration, improper storage, or use inconsistent with the product description is not considered a product defect.

4. Product Availability

Products are offered subject to availability.

Placing a product in the shopping cart does not reserve the item.

We may reasonably limit quantities, discontinue products, update inventory information, or correct availability information when necessary.

If a product becomes unavailable after an order is submitted, we may cancel the affected item and issue a refund to the original payment method.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An automated order-receipt or order-confirmation email confirms that we received your order but does not necessarily mean that the order has been accepted for fulfillment.

An order is accepted after payment has been successfully authorized and we confirm that the order can be fulfilled.

We may decline, limit, or cancel an order for legitimate reasons, including:

Product unavailability;

Incorrect pricing or product information;

Payment-authorization problems;

Suspected fraud or unauthorized activity;

An incomplete, inaccurate, or invalid delivery address;

Orders outside our supported shipping area;

Unusually large quantities or suspected unauthorized resale; or

Legal or regulatory requirements.

If we cancel an order after payment has been collected, we will issue the appropriate refund to the original payment method.

6. Prices and Payment

All prices are displayed in United States dollars (USD) unless otherwise stated.

Applicable shipping charges, taxes, discounts where applicable, and the total order amount will be displayed during checkout before the order is submitted.

We currently accept payment through PayPal only.

Payment providers process payment information according to their own terms, policies, and security procedures.

We do not directly store complete payment-card details or payment-account login credentials where those details are processed by the applicable payment provider.

7. Pricing and Website Errors

We make reasonable efforts to ensure that product information and prices displayed on the Website are accurate.

However, typographical errors, inaccurate product information, pricing errors, inventory errors, or other Website mistakes may occasionally occur.

We may correct these errors when reasonably necessary.

If an error materially affects an order that has already been submitted, we may contact the customer to request confirmation or cancel the affected item and issue an appropriate refund.

We will not substitute a materially different product without the customer's agreement.

8. Shipping and Delivery

We currently accept orders for delivery to eligible addresses within the 48 contiguous United States.

We do not currently ship to Alaska, Hawaii, Puerto Rico, other U.S. territories, APO/FPO/DPO addresses, or international destinations.

Processing times, shipping charges, estimated delivery periods, tracking procedures, address requirements, carrier delays, multiple-package shipments, and delivery problems are governed by our Shipping Policy.

Delivery estimates are provided for reference and are not guaranteed delivery dates.

Customers are responsible for providing a complete and accurate delivery address during checkout.

9. Returns and Refunds

Eligible products may be returned according to our Return and Refund Policy.

We currently accept eligible return requests submitted within 30 days after delivery.

Return eligibility may depend on factors including:

The date the return request is submitted;

The condition of the product;

Whether the glassware shows signs of use;

Whether all original components are included;

Whether the product has been chipped, cracked, scratched, altered, or damaged after delivery; and

Whether return authorization was obtained before the product was sent back.

Personal-reason returns and returns involving damaged, defective, incomplete, or incorrect products may have different return-shipping responsibilities.

Our Return and Refund Policy governs return authorization, return shipping, return inspection, damaged-product claims, refunds, and other return-related procedures.

Nothing in these Terms limits consumer rights that cannot legally be excluded.

10. Personal and Household Use

Products purchased through the Website are intended primarily for personal and household use unless otherwise stated.

You may not use the Website or purchase products for fraud, unlawful export, unauthorized commercial resale, or other unlawful activity.

Wholesale purchases or commercial resale may require our prior written approval.

11. Intellectual Property

The Website and its content—including the KERAANN name, logo, product descriptions, photographs, graphics, text, layout, and other materials—are owned by or licensed to KERAANN and may be protected by applicable intellectual-property laws.

You may use the Website for personal shopping and other lawful personal purposes.

You may not copy, reproduce, republish, distribute, modify, scrape, sell, or commercially exploit Website content without prior written permission, except where permitted by applicable law.

Third-party names, trademarks, logos, photographs, and other materials remain the property of their respective owners.

12. Reviews and Submitted Content

If you submit a product review, photograph, suggestion, comment, or other content, you confirm that:

You own the content or have permission to submit it;

It reflects your genuine experience where it relates to a product experience;

It is not false or misleading;

It does not violate another person's intellectual-property, privacy, or other legal rights;

It is not unlawful, abusive, defamatory, threatening, or obscene; and

It does not contain spam, malware, or unauthorized advertising.

To the extent permitted by law, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display submitted content for purposes related to operating and promoting the Website and our products.

We may remove submitted content that violates these Terms or applicable law.

13. Prohibited Uses

You may not:

Use the Website for unlawful, fraudulent, deceptive, or abusive activity;

Provide false customer, billing, payment, or delivery information;

Attempt unauthorized access to the Website, customer accounts, servers, or related systems;

Introduce viruses, malware, malicious code, or other harmful technology;

Interfere with Website security, availability, or operation;

Collect personal information about others without authorization;

Impersonate another person or entity;

Infringe intellectual-property, privacy, or other legal rights;

Submit unauthorized advertising or spam; or

Use automated systems in a manner that disrupts or places an unreasonable burden on the Website.

We may restrict access when we reasonably believe these Terms have been materially violated.

14. Shopify and Third-Party Services

Our online store is hosted using Shopify’s ecommerce platform.

Shopify provides Website, ecommerce, and checkout infrastructure that helps us operate our online store.

Shopify is not the seller of the products offered through KERAANN. Purchases made through the Website are transactions between the customer and KERAANN.

We may also use third-party providers for payment processing, shipping, analytics, fraud prevention, customer support, Website functionality, and other services necessary to operate our business.

Third-party providers operate under their own terms, policies, and privacy practices.

We are not responsible for independent third-party websites or services that are outside our reasonable control.

15. Privacy

Our collection, use, disclosure, and handling of personal information are described in our Privacy Policy.

Information may be processed by Shopify, payment providers, shipping providers, analytics providers, fraud-prevention providers, and other service providers where reasonably necessary to:

Operate the Website;

Process payments;

Fulfill and deliver orders;

Provide customer support;

Prevent fraudulent activity;

Maintain Website security; and

Comply with applicable legal obligations.

16. Website Availability and Disclaimer

We make reasonable efforts to maintain accurate Website information and reliable Website operation.

However, the Website may occasionally be unavailable or interrupted because of maintenance, updates, technical problems, security issues, service-provider interruptions, or circumstances outside our reasonable control.

To the fullest extent permitted by applicable law, the Website is provided on an “as available” basis.

We do not guarantee that the Website will always operate without interruption or error.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, KERAANN will not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the Website.

We are not responsible for product damage or other losses caused by:

Dropping or impact;

Improper handling;

Improper cleaning;

Thermal shock;

Modification or alteration;

Improper storage; or

Use contrary to the product description or applicable care instructions.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold KERAANN harmless from third-party claims or reasonable expenses resulting from:

Your unlawful use of the Website;

Your material violation of these Terms;

Fraudulent or intentionally harmful conduct; or

Your infringement of another person's legal rights.

This provision does not apply to claims caused by our own violation of applicable law or these Terms.

19. Governing Law

These Terms are governed by the laws of the State of Colorado and applicable federal laws of the United States, without regard to conflict-of-law principles.

Disputes will be handled by a court or other forum with lawful jurisdiction, subject to any mandatory consumer rights allowing a claim to be brought elsewhere.

We may update these Terms when our Website, products, services, business practices, or legal obligations change.

The updated version will be posted on this page with a revised “Last Updated” date.

Changes apply prospectively and do not retroactively change the material terms of an order already accepted unless required by applicable law.

21. Severability and No Waiver

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Our failure to enforce a provision on one occasion does not waive our right to enforce that provision later.

These Terms, together with the policies and information linked or referenced on the Website, constitute the agreement concerning use of the Website and purchases from KERAANN.

If a specific policy conflicts with these Terms regarding its particular subject, the more specific policy applies to that subject.
